Did Shawn Reilly really say this? He wants to show concern for the hurt feelings of people on the "other side" of any issue so he wants meetings to be closed for that reason alone?

What municipal attorney would even consider allowing this?

Hi, Vicky -

We went briefly into closed session last night under a provision in the open meetings law that allows closed session "whenever an open discussion would compromise the government's bargaining position by revealing its negotiation strategy." When Shawn referred to making the other party "upset," he meant "upsetting bargaining and negotiations," not "hurting their feelings."

The closed session lasted only as long as it took to determine whether the common council felt that there should be any further negotiation and bargaining with Milwaukee. When they determined that we had no more negotiating to do, we had no more legal justification to remain in closed session. At that time, I advised the council to go out into open session and to have a full discussion of the matter, which they did. Any council member will tell you that is exactly what happened.

As it turned out, there was a very complete discussion of the water service contract in open session before the council voted, and it included virtually everything that was discussed in closed session.

There were extensive discussions before the meeting as to what could be discussed in closed session and what would have to be discussed in open session. We work hard to make sure we are in compliance with the open meetings law, and all other laws.

I will attest that Brian’s explaination is 100% correct. As soon as we could get in to open session as advised, we did. Very comforatable with the process.
